These Terms & Conditions define the rules for using the online store Sexy Matcha (the “Store”), available at www.sexymatcha.pl, and for concluding and performing sales contracts with the Seller.

These Terms & Conditions are prepared in accordance with Polish law, including the Act of 30 May 2014 on Consumer Rights, the Polish Civil Code, the Act on Providing Services by Electronic Means, and applicable EU regulations.

  1. 1. DEFINITIONS
    For the purposes of these Terms & Conditions:
    • Seller – Sexy Matcha Kacper Folan, operating the Store.
    • Store – the online store available at www.sexymatcha.pl.
    • Customer – any entity using the Store and placing an order.
    • Consumer – a natural person making a purchase not directly related to their business or professional activity.
    • Goods / Products – products offered for sale in the Store, including matcha and related goods.
    • Distance Contract – a contract concluded without the simultaneous physical presence of the parties, using means of distance communication.
    • Business Days – Monday to Friday, excluding public holidays in Poland.
  2. 2. TECHNICAL REQUIREMENTS
    To use the Store, the Customer must have:
    • a device with internet access,
    • an up-to-date web browser,
    • an active email address.
    The Seller is not responsible for disruptions caused by technical issues on the Customer’s side.
  3. 3. PRODUCTS AND PRICING
    All products offered in the Store are new and legally introduced to the Polish market.
    Prices:
    • are given in Polish złoty (PLN),
    • include VAT (if applicable),
    • do not include delivery costs (unless clearly stated otherwise).
    The total price, including delivery costs, is presented to the Customer before the order is placed.
    Product photos are for illustrative purposes and may slightly differ from the actual appearance of the product (e.g., packaging details), without affecting its key features.
  4. 4. ORDER PROCESS AND CONCLUSION OF THE CONTRACT
    To place an order, the Customer should:
    1. Select products and add them to the cart.
    2. Provide required delivery and contact details.
    3. Select a payment and delivery method.
    4. Confirm the order and accept these Terms & Conditions.
    The sales contract is concluded at the moment the Seller confirms acceptance of the order by email.
    The Seller reserves the right to refuse or cancel an order in justified cases, including:
    • incorrect pricing due to an obvious technical error,
    • lack of product availability,
    • failure to receive payment within the required time (where applicable).
  5. 5. PAYMENT METHODS
    The Store offers payment methods available at checkout, including online payments and card payments via Przelewy24, and other methods if indicated in the Store.

    Payments are processed securely via the Przelewy24 system. The Seller does not store full payment card details.
  6. 6. DELIVERY
    Delivery is available in Poland and in other countries if offered by the Store.
    Delivery time and available methods are presented during checkout.
    Delivery costs are clearly indicated before the Customer confirms the order.
    For Consumers, the risk of accidental loss or damage to the goods passes to the Consumer upon delivery.
  7. 7. RIGHT OF WITHDRAWAL (CONSUMERS)
    Consumers have the right to withdraw from a distance contract within 14 days without giving any reason.
    Detailed rules for withdrawal, returns, and refunds are described in the Refund & Returns Policy available on the Store’s website.
    In accordance with Article 38 of the Polish Consumer Rights Act, the right of withdrawal does not apply to certain categories of goods, including perishable goods and sealed food products once opened (where applicable).
  8. 8. COMPLAINTS (NON-CONFORMITY OF GOODS)
    The Seller is liable for non-conformity of goods with the contract under Polish law.
    If the product is defective or non-compliant, the Customer may request remedies provided by law, including repair, replacement, price reduction, or withdrawal from the contract (where applicable).

    To help us process your complaint efficiently, please include the order number, a description of the issue, and photos (if possible).
    Complaints are processed within 14 days.
  9. 9. FOOD PRODUCTS – STORAGE AND SAFETY
    Matcha and related products offered in the Store are food products. After delivery, the Customer is responsible for:
    • proper storage conditions (cool, dry place, away from sunlight),
    • following the instructions provided on packaging or product pages,
    • checking ingredients and allergen information.
    The Seller is not liable for quality deterioration caused by improper storage or use after delivery.
  10. 10. PERSONAL DATA
    Personal data are processed in accordance with the Privacy Policy available on the Store’s website.
    Data are processed for the purpose of order fulfillment, legal compliance, and marketing activities where consent is given.
  11. 11. INTELLECTUAL PROPERTY
    All content available in the Store, including text, product descriptions, images, graphics, branding, and logos, is protected by copyright and other applicable laws.
    Any use of Store content without the Seller’s prior written consent is prohibited.
  12. 12. OUT-OF-COURT DISPUTE RESOLUTION
    Consumers may use out-of-court complaint and redress mechanisms in accordance with Polish and EU regulations.

  13. 13. PROVISIONS APPLICABLE TO BUSINESS CUSTOMERS (B2B)
    The provisions of this section apply to Customers who are not Consumers within the meaning of the Polish Civil Code.
    In relation to Business Customers:
    • The Seller’s liability under statutory warranty for defects (rękojmia) is excluded pursuant to Article 558 §1 of the Polish Civil Code.
    • The Seller shall not be liable for lost profits.
    • The Seller shall not be liable for indirect, consequential, incidental, or special damages.
    • The Seller’s total liability, regardless of its legal basis, shall be limited to the net value of the order giving rise to the claim.
    The right of withdrawal within 14 days applies exclusively to Consumers. Business Customers are not entitled to withdraw from the contract unless otherwise agreed in writing.
    Any disputes with Business Customers shall be resolved by the court having jurisdiction over the Seller’s registered office.
  14. 14. ENTREPRENEURS WITH CONSUMER RIGHTS
    A natural person concluding a contract directly related to their business activity may benefit from selected consumer rights, provided that the contract does not have a professional character resulting in particular from the subject of their business activity registered in CEIDG.
    In such cases, provisions concerning Consumers, including the right of withdrawal and statutory warranty rights, shall apply to the extent required by applicable law.
  15. 15. FORCE MAJEURE
    The Seller shall not be liable for failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, strikes, supply chain disruptions, or technical failures.
  16. 16. FINAL PROVISIONS
    Polish law applies to contracts concluded through the Store.
    The Seller may amend these Terms & Conditions for important reasons, including changes in law, payment methods, delivery methods, or business operations.
