Refund and Returns Policy

This Refund and Returns Policy applies to purchases made through the online store Sexy Matcha (the “Store”), available at www.sexymatcha.pl, and operated by:

This Policy has been prepared in accordance with the Polish Act of 30 May 2014 on Consumer Rights, the Polish Civil Code, and applicable European Union legislation.

  1. 1. RIGHT OF WITHDRAWAL (14 DAYS)

    Consumers have the right to withdraw from a distance contract without providing any reason within 14 days.

    The withdrawal period expires 14 days after:

    • The day on which you acquire possession of the goods, or a third party indicated by you (other than the carrier) acquires possession.
    • In the case of multiple goods delivered separately, in batches or in parts — the day you acquire possession of the last item, batch, or part.
    • In the case of contracts for regular delivery of goods over a specified period — the day you acquire possession of the first item.

    To exercise the right of withdrawal, you must send a clear statement of your decision to withdraw from the contract to:

    You may use a model withdrawal form, but this is not mandatory.

  2. 2. RETURN PROCEDURE

    After submitting your withdrawal statement, you must return the goods without undue delay and no later than 14 days from the date you informed us of your withdrawal.

    The deadline is met if the goods are sent back before the 14-day period expires.

    Unless otherwise agreed, you bear the direct cost of returning the goods.

  3. 3. CONDITION OF RETURNED GOODS

    To qualify for a refund, the product must:

    • Be unused
    • Be in its original packaging
    • Include all original labels and protective elements
    • Not show signs of use beyond what is necessary to establish its nature and characteristics

    You are responsible for any diminished value of the goods resulting from use beyond what is necessary for inspection.

    Proof of purchase (receipt or order confirmation) is required.

    Goods returned without prior notification may not be accepted.

  4. 4. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

    In accordance with Article 38 of the Polish Consumer Rights Act, the right of withdrawal does not apply to:

    • Perishable goods or goods with a short shelf life (including food products such as matcha)
    • Sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed
    • Custom-made or personalized products
    • Digital content supplied without a tangible medium where performance has begun with consumer consent
    • Gift cards

    If you are unsure whether your product qualifies for return, please contact us before sending it back.

  5. 5. DAMAGED OR INCORRECT ITEMS

    Please inspect your order immediately upon receipt.

    If the product is defective, damaged, incomplete, or incorrect, contact us without delay at:

    We will assess the issue and provide a suitable solution in accordance with Polish consumer protection law.

  6. 6. REFUNDS

    We will notify you once we have received and inspected your return.

    If approved:

    • The refund will be issued using the same payment method used for the original transaction.
    • The refund will be processed no later than 14 days from the date we were informed of your withdrawal.
    • We may withhold reimbursement until we receive the returned goods or proof that they have been sent back.

    Refunds include the cost of standard delivery (the least expensive delivery option offered in the Store).

    Banks and payment providers may require additional processing time.

  7. 7. COMPLAINTS (NON-CONFORMITY OF GOODS)

    If the product is not compliant with the contract, you have rights under Polish law, including:

    • Repair
    • Replacement
    • Price reduction
    • Withdrawal from the contract (where legally applicable)

    Complaints are processed within 14 days.

  8. 8. PERSONAL DATA

    Personal data provided in connection with returns or complaints are processed in accordance with the Sexy Matcha Privacy Policy and applicable GDPR regulations.

    Data are processed solely for the purpose of handling returns, processing refunds, managing complaints, and fulfilling legal obligations.

  9. 9. CHANGES TO THIS POLICY

    Sexy Matcha reserves the right to amend this Refund and Returns Policy in accordance with applicable law.
